Gift Entry is referred to as Gift Token in the remainder of this document.
Please read this page carefully before buying your Gift Token. These terms and conditions form the basis of an Agreement between us (Nova International), and you (the purchaser)
In these Conditions the following definitions shall apply:
"Agreement" - the agreement between you and Nova International Limited;
“Gift Entry” / “Gift Token” – the right to enter and Event to be redeemed by yourself or a nominated person
"Event" - the event organised by Nova International Limited which is the subject of the Gift Token;
“Recipient” –the person nominated to receive the Gift Token
"we, Nova" - means Nova International Limited ;
"you" -means the Purchaser of the Gift Token.
Gift tokens purchased from Nova will be issued by email to the person nominated by the purchaser, the “recipient” of the token.
Gift Tokens are valid up to the closing date of entry. The email sent to the recipient advises of this closing date. The recipient must activate the Gift Token by email or by contacting info@greatrun.org before the closing date.
Gift Token’s cannot be extended after the closing date, transferred to another Event or rolled forward to another year.
As the purchaser if you change your mind about your Gift Token purchase for instance, because the recipient might not be able to take part in the Event on the specific date, please contact us within 28 days of purchase and we will happily arrange a full refund (less, where applicable, our administration costs). Refunds will be paid back onto the credit/debit card used to place the original order, or by cheque.
Please note that once the recipient has signed up to the Event by redeeming the Gift Token, refunds will be given solely to you the purchaser and only in the following specific circumstances:-
If the recipient incurs an injury or develops a medical condition which prevents them from participating in the Event and needs to withdraw. Refunds will be accepted up to six weeks prior to the date of an Event. After this time no refund will be offered. We reserve the right to retain £5.00 (€5.00) from any refund given to you as a contribution to administration costs.
We may cancel the Event, at any time, if circumstances beyond our reasonable control arise, including, without limitation, war, civil or political unrest, terrorism or inclement weather conditions. We reserve the right to retain £5.00 (€5.00) from any refund given to you as a contribution to administration costs.
We reserve the right to cancel the Event if one month before the date of the Event we have not, in our sole discretion, received sufficient number of applications to ensure that there are enough participants to make the Event economically viable. In this case you will be given a full refund.
You agree that your personal data can be stored and used by Nova in connection with the administration of the sale of Gift Tokens.
We shall ensure that we comply with the provisions and obligations imposed on us by all regulations relating to data protection.
All personal data acquired by us from you shall be returned or deleted (at your option) on request except to the extent required by us to discharge our obligations under this Agreement or under any regulations relating to data protection, and any personal data which are retained shall be returned or deleted immediately when they are no longer required for those purposes.
In no event shall we be liable to you, whether for breach of contract, any tortious act or omission (including negligence) or otherwise, under or in connection with the Agreement for any:
consequential or indirect loss, regardless of whether the loss or damage:
(a) would arise in the ordinary course of events;
(b) is reasonably foreseeable; or
(c) is in the contemplation of the parties, or otherwise.
The Agreement shall be governed by English law, and the parties submit to the exclusive jurisdiction of the English courts.
If any provision of the Agreement is invalid or unenforceable, in whole or in part, the validity of the remainder shall not be affected.
The Agreement does not create, confer or purport to confer any benefit or right enforceable by any person not party to it.
Nothing in the Agreement shall have the effect of holding the Partners out as being a partnership, joint venture, principal or agent of each other or of Nova International Limited.
